Instructions

Originally Fenn Wright were asked to provide marketing advice in respect of a fish farm which had the benefit of a dwelling with an agricultural occupancy condition. Fenn Wright advised the clients to hold off marketing until a CLUED had been submitted to the Local Planning Authority and a decision made.

We were instructed by the clients local agent to prepare a planning application for the removal of the occupancy condition.

Advice

Fenn Wright advised the clients to provide as much evidence as possible to demonstrate that the occupancy condition had not been complied with. The evidence included personal statements, utility bills, stocking evidence, photographs and plans.

Outcome

A planning application with a supporting statement and the necessary evidence was submitted to the Local Planning Authority. There was a positive outcome for the clients as it was determined that the dwelling had been occupied in breach of the original occupancy condition. The property was subsequently sold by Fenn Wright at a considerably higher price than it would have achieved with the original condition.
